What Information Do I Need to Collect After a Truck Accident in Colorado?

Print Page

Truck accidents can result in serious injuries for drivers and passengers. Anyone who has been injured in a truck accident should seek medical attention promptly; and, if possible, take appropriate steps to preserve their legal rights. This includes collecting the following key pieces of information.

Information about the Truck

While the truck driver is not always at fault in a truck accident, frequently this is the case. Loading errors, inadequate maintenance and various other truck-related issues can cause dangerous accidents as well. As a result, in the event of a truck accident, it is important to gather identifying information about the truck. The license plate state and tag number should be enough, but it can be helpful to write down the name on the side of the truck and any visible contact information as well.

Damage to Each Vehicle

Taking photos at the scene of the accident is the best way to preserve evidence of the location and extent of the damage to each vehicle involved. Try to photograph each vehicle from all angles, and take photos of any parts or debris before removing them from the road.

Road, Traffic and Weather Conditions

Here, too, a photograph is truly worth a thousand words. Take as many photos (or videos) of the crash site and surrounding area as you can, and make note of any details that might not be readily-apparent from your images or footage.

Insurance Information

It will be important to obtain insurance information from each of the drivers involved in the accident. Why? While trucks and truck drivers are usually to blame, it could be that another driver caused or contributed to the accident as well. If this is the case, you will want his or her insurance information so that you can file a claim under his or her policy.

Witnesses’ Contact Information

Did anyone who was not involved witness the accident? If so, and if he or she stopped at the scene, you will want to politely ask for his or her contact information.

Police Report

When a police officer responds to the scene of an accident, he or she will prepare a police report. Try to make sure you get a copy before leaving the scene.

Medical Records

Shifting gears, ideally, you should seek medical attention immediately following any collision involving a commercial truck. As you receive copies of your scans, medical bills, and receipts, make sure you keep copies so that you can provide them to your attorney.

Employment Records

Whether you miss a couple of days from work to seek medical treatment or you are never able to return to work as a result of your injuries, your loss of income will be an important component of your claim for damages.

Daily Pain Log and Injury Journal

While traumatic injuries from a truck accident can be all-consuming in the moment, memories fade over time. To ensure that you are able to seek maximum compensation for your non-financial losses (i.e. pain and suffering), you should keep records of your daily pain levels and the impairing effects of your injuries.

I have known Andrew Phillips with Levine Law for many years and have a great respect for him as a person and a law professional. I never really needed his services for myself but last year a friend of my was having a lot of trouble getting a settlement due him from an insurance company. The insurance company just kept giving my friend one excuse after another. I asked Andrew if he could help my friend. I was amazed at what a great job Andrew did. He contacted my friend in a timely fashion and the matter was settled in no time. This wasn't even for me, just someone I knew. I recommend him highly. You will not go wrong working with Andrew.
